Spar and their Workmans Comp Requirement

Does anyone have experience with Spar? I was told the 4% workmans comp deduction is a condition of doing business with them. It is a part of the IC agreement and the only deduction taken, no taxes, etc and I get a 1099 at years end. So we are clearly treated as IC's from Spar.

I would rather not pay the 4%, has anyone successfully gotten out of it? Spar told me if I didn't agree to it, they wouldn't award me any stores.

I think the suggestion on the other thread to contact your state labor board may be the best thing right now. I don't work for Spar and questioned the deduction because the laws I found stated clearly the IC is not eligible to submit a worker's comp claim meaning if Spar is collecting it the IC cannot get any benefit back. If on the other hand they are supplying some type of IC insurance you can claim against, they are confusing the issue by the wording on the pay stubs.

Agree...suggest you contact your state labor department, and/or workers compensation authorities if you are in a monopolistic state (like West Virginia or North Dakota).

An IC has no ability to collect workers comp because they are not an employee. It is illegal for an employer to charge employees for workers comp coverage. This is a 4% kickback, as a condition of doing business.

The easiest thing: 40-foot pole. Sounds like Spar wants to have its cake and eat it, too.
SPAR requires you to supply your own worker's comp insurance. But, if you don't have it, don't know where to get it, or only want it for SPAR because they require it, then they will buy it for you. They buy it from a 3rd party and they don't keep any money from it. It's best to have your own worker's comp plan as an I.C. anyway. Try to get your own if you can because it's cheaper and the benefits are higher as they use 'your' information rather than use a general consensus of someone with your stats. SPAR sucks anyway.
Did you have a bad experience with SPAR Spicy? They have treated me well... except for the WC issue lol.
They're like most other small merchandising company, they want way too much for way too little. They want you to wear business casual clothing on $10.00 an hour...yadah yadah.
